Kosovo Prime Minister, Ramush Haradinaj, during Government’s meeting on Wednesday said the Association of Serb-majority Municipalities, reached during the EU-facilitated dialogue with Serbia in Brussels, will be established based on the Constitution of Kosovo and the decision of the Constitutional Court.
“Drafting of the statute of the Association of Serb-majority Municipalities will be done in compliance with the Constitution of Kosovo and the final verdict will be given by the Constitutional Court of Kosovo,” Haradinaj said.
Kosovo's Constitutional court in a decision in 2015 has endorsed the controversial agreement which is being contested by opposition parties of Kosovo claiming that the Association gives the Serbian minority in Kosovo too much power. However the Court ruled that some of the principles of the agreement did not fully comply with the spirit of Kosovo's constitution.
The President Hashim Thaci and Prime Minister Ramush Haradinaj have reactivated last week a managerial team in charge for drafting the statute of the Association. Haradinaj informed his cabinet that the Managerial Team will commence its work soon and is obliged to report to Brussels in monthly basis. “The statute of the Association will be sent to the Constitutional Court for an interpretation to see whether it is in compliance with the Constitution,” he said.
Maja Kocijancic, the spokeswoman of the EU High Representative Federica Mogherini told Belgrade media on Tuesday that the Association will be set up within the legal framework of Kosovo. Serbian President Aleksandar Vucic reacted to Kocijancic’s statement saying that the Association can only be formed in accordance with the Brussels agreement, its principles and the implementation plan. Vucic also said he was "surprised by this statement."
"I want to them to show us where this is written in the Brussels agreement, I know the Brussels agreement by heart, you can find it on the websites of the government, the president, the Office (for Kosovo), it does not say that anywhere," Vucic told Serbia’s public broadcaster – RTS late on Tuesday.
The principles of the deal on Association were agreed during EU-facilitated Kosovo-Serbia dialogue in Brussels in August 2015, and stipulate that Kosovo Serbs should have full “oversight” over economic development, education, healthcare, urban and rural planning, with budgetary contributions coming directly from Serbia. In exchange, the municipalities would agree to full integration into Kosovo.
